Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Case Builder cloud-based legal case management platform, accessible at casebuilder.com and app.hybridfb.com(the “Service”), operated by Case Builder Systems Inc. (“we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration and Eligibility

  • You must be at least 18 years old to create an account.
  • You must provide accurate, current, and complete registration information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must notify us immediately at support@hybridfb.com of any unauthorized use of your account.

2. Free Trial

  • New users receive a 14-day free trial with access to all Pro-tier features and 1 GB of cloud storage.
  • No credit card is required to start the trial.
  • At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your access will be suspended and your data retained for 30 days before permanent deletion.
  • We reserve the right to modify or discontinue the free trial offer at any time with reasonable notice.

3. Subscription Plans and Billing

We offer the following subscription tiers (prices in USD):

  • Pro: $7.99/month or $75/year — for individual legal professionals. Includes 15 GB storage, single user, unlimited bundles, automatic index generation, document annotations, and priority email support.
  • Enterprise: $14.99/month or $144/year — for firms and teams. Includes unlimited storage, up to 10 team seats, custom cover page designer, unlimited bundle exports, and dedicated priority support.
  • Payments are processed securely through PayPal. You are responsible for any applicable taxes.
  • Annual plans are billed in advance for the full year. Monthly plans are billed on a recurring monthly basis.
  • You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Changes take effect at the start of the next billing cycle.
  • No refunds are issued for partial months or unused time, except as required by applicable law.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload, store, or transmit any content that infringes third-party intellectual property rights.
  • Upload malicious code, malware, or any material designed to disrupt or impair the Service.
  • Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service.
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.
  • Use the Service to build a competing product or service.

5. Intellectual Property

  • Your Content: You retain all rights to the documents, case files, annotations, and other materials you upload or create within the Service (“Your Content”). We claim no ownership over Your Content.
  • License to Us: By using the Service, you grant us a limited, non-exclusive license to host, store, and process Your Content solely for the purpose of providing the Service to you.
  • Our IP: The Service itself (including its code, design, branding, and documentation) is owned by Case Builder Systems Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.

6. Third-Party Services

The Service integrates with third-party services, including PayPal for payment processing and Wasabi S3 for cloud storage. We are not responsible for the availability or practices of these third-party services. Your use of such services is governed by their respective terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASE BUILDER SYSTEMS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Case Builder Systems Inc. from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

  • By You: You may stop using the Service and delete your account at any time through your account settings or by contacting support.
  • By Us: We may suspend or terminate your account if you breach these Terms, with notice where reasonably possible. For non-material breaches, we will provide 14 days to cure the breach before termination.
  • Effect of Termination: Upon termination, your access to the Service ceases immediately. Your Content is retained for 30 days, after which it is permanently deleted. You may request an export of Your Content within that 30-day window.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or a prominent notice within the Service at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you disagree with the changes, you must discontinue use and delete your account.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Wilmington, Delaware, unless otherwise required by applicable law.

13. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Case Builder Systems Inc. regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
